General
The here specified conditions governing the Customer's use of goods and services provided by Marine Parts.
These terms apply to all sales from Marine Parts so long as otherwise agreed in writing between the parties.
Prices and Delivery
All prices listed items. shipping, unless otherwise expressly noted. Prices are constantly changing, and we are therefore subject to price change as a result of changes in prices from our suppliers.
We reserve the right to refuse delivery on all items based on price fluctuations and stock situation. All delivery times given by us must be considered as indicative. The delivery means the time of arrival of goods at our warehouse. Elapsed time for picking, packing and eventual production will be added before delivery of the shipment to the carrier. When time is set in days, mean days and couriers time always comes in addition.
We reserve the right to deviate on given delivery time without further notice. Any price occurring after time of ordering will not be retroactive. We reserves the right to typing-/printing.
If there have been any writing or printing errors of significant size from Marinedelers side, this can be changed without exception, if the client is made aware of the relationship in advance and within a reasonable time after the defect is discovered.
Customer's obligations
Anyone who is registered with the Marine Parts, is responsible for payment of the services or Marine Parts Marinedelers partners deliver in accordance with the present conditions. The responsibility includes also others' use of customer access, including unauthorized use, as long as it can be proven that unauthorized use has been made possible due to the negligence of Marinedelers page.
Uncollected
If unclaimed packages the customer will be charged a fee of £. 250, - for unclaimed goods, to cover our costs for breach of contract.
Complaints
Before faults are reported to Marine Parts, customer should check if the error is caused by the customer. If the customer can demonstrate that the product does not work as Marine Parts has described it to do, the customer must notify the Marine Parts Marine Parts so that you can take remedial measures. The customer loses his right to make a fault if he does not give Marine Parts notification within a reasonable time after he discovered or should have discovered the defect.
Remedy
Marine Parts shall as soon as possible after being notified of a faulty product by the Marine Parts, implement measures to correct the defect. If the customer on their own initiative, take steps to rectify the defect in excess of what had to be agreed with Marine Parts, Marine Parts do not pay these expenses.
Regret
The Act applies only when consumer goods. Return costs are borne by the consumer (cf. Withdraw Act § 15 first paragraph).
Extraordinary circumstances
Marine Parts are only responsible for the loss of the item if it is proven wrong or missing. This does not apply if the Marine Parts proves that the defect is due to circumstances beyond the control Marine Parts, Marine Parts and could not reasonably be expected to avoid or overcome the consequences of.
Marine Parts is not responsible for indirect losses caused by defects unless the loss was caused by gross negligence or intent Marinedelers page.
In consumer terms can not be worse than the conditions set by law. Act on Consumer Purchase of No. 34 2002-06-21
Sales Mortgage / Payment Terms
Marine Parts has a lien on the goods sold as security for his claim on the purchase price plus interest and costs, cf. mortgage Act § 3-14 et seq
Only companies and public agencies that will buy goods on credit, and it will be made before the credit rating distribution of ordered items.
Change in terms
Marine Parts reserves the right to change the present conditions, including as a result of changes in legislation.
Force majeure
Is Marine Parts prevented from delivering or making mandatory re-delivery or should such a delivery unduly burdensome due to labor dispute or any other circumstance where the parties have no control over it such as fire, war, mobilization or unforeseen military call-ups of similar scope, requisition, confiscation , currency restrictions, riots and disturbance, shortage of transport, general shortage of goods, reduction in the supply of power and lack of or delay in deliveries from sub suppliers or manufacturers as a result of such circumstances described in this paragraph, the Marine Parts relieved of all other liability than in cases of complaints and attribute it to the lack of corresponding commodity price.
